As of January 1, 2018, there were significant changes implemented by the Ontario government that went well beyond an increase in the minimum wage. Additional changes that were set out in the Bill 148 amendments to the Employment Standards Act will take effect later this year and into 2019. Many of these changes will significantly impact employers, including wage parity for part-time and casual staff to full-time, increased vacation pay, Personal Emergency Leave for all employers, with the first two days per year paid, as well as changes to scheduling and on call requirements that can also require payment for certain hours even where there is no work available. Other changes are administrative in nature such as the new calculation for statutory holiday pay. Employers who are not in compliance can face fines and orders to pay from Employment Standards Officers who can audit your employment practices.
Bill 148 also amended the Labour Relations Act to provide additional protections and opportunities for workers to organize and join a union. It is important to understand these requirements if your organization is faced with an organizing drive or receives an application from a union at the Labour Relations Board. Where an employer commits an unfair labour practice, this can result in automatic unionization, even without a vote, and if there was a reprisal or termination of an employee, they can be reinstated to their former position.
